Federal Section 280E and marijuana scheduling can materially affect a cannabis business. As of August 2026, federal rescheduling proceedings had occurred, but a proposal or hearing is not a final, effective tax-law change. California treatment can also differ by entity type and licensing status. We verify the tax year, effective law, and operator facts before giving client-specific advice.

It can. The answer depends on the federal scheduling and tax law effective for the tax period. A proposal or hearing does not by itself change a filed tax position.
